| 近年来发达经济体通过区域与双边协定谈判的方式推动制定国际知识产权新规则。新规则在知识产权实体权利、边境措施、民事救济与刑事处罚以及数字环境执法4个方面显示出明显的“超TRIPS”特征。随着新规则的逐渐扩散，我国将面临一个高知识产权壁垒的外部市场，并带来调整国内知识产权保护制度的压力。对此，我国应结合创新型国家建设进程，主动参与和影响新规则的制定，并从技术层面考虑对某些新规则的接纳。 |

| In recent years, advanced economies have been promoting the development of new international intellectual property rules through negotiations of regional and bilateral agreements. The new rules show obvious “TRIPS-plus” features in four aspects: substantive rights, border measures, civil remedies and criminal procedures, and digital environment enforcement. With the gradual spread of the new rules, China will face an external market with high intellectual property rights barriers and pressure to adjust domestic intellectual property protection system. In this regard, China should actively participate in and influence the formulation of new rules in conjunction with the process of building an innovative country, and consider the acceptance of certain new rules from a technical perspective. |
